1. GENERAL INFORMATION, DEFINITIONS

1. These Terms and Conditions set out the rules for using the educk.org online platform, operated by Jan Tuziak, conducting business under the company name All in Red Jan Tuziak (NIP 9930669392, REGON 381684629). Contact email: educk@educk.org.

2. These Terms and Conditions cover the rules for using the products available on the platform.

3. The terms used in these Terms and Conditions have the following meanings:

   • Customer – a natural person with full legal capacity, a legal person, or an organizational unit without legal personality, placing orders and purchasing Products on the Platform.

   • Product – electronic products (digital content) available on the platform.

   • Platform – the online platform available at educk.org, through which the Customer places orders and gains access to Products.

   • Agreement – the contract for the sale of Products concluded between the Owner and the Customer via the Platform.

   • Owner – All in Red Jan Tuziak (NIP 9930669392, REGON 381684629), responsible for selling via the Platform.

   • Order – a declaration of intent by the Customer aimed at concluding an Agreement, specifying, in particular, the type and quantity of the Product.

4. Materials used to present products, including images, descriptions, and other content, are part of the Platform and are owned by the Owner. These materials are protected by copyright law and may not be used for commercial purposes or displayed in any media without the Owner’s consent.

5. Product prices are listed in US dollars (USD) and include VAT.

2. USE OF THE PLATFORM

1. To place an order, the Customer selects Products on the Platform and follows the displayed instructions.

2. The Customer adds Products to the “cart,” where they can modify their selection and proceed to checkout.

3. During the ordering process, the Customer specifies details such as billing information, email address, payment method, etc.

4. Registration on the Platform may be required to access certain Products.

5. Registration allows the Platform to store Customer data and order history, as well as provide access to purchased digital content.

6. The Customer is responsible for keeping their password confidential.

3. PLACING AN ORDER

1. Orders are accepted exclusively online via the Platform.

2. The order will be processed only if the order form is correctly completed.

3. The Customer must provide accurate personal data, email, and billing details.

4. Before confirming the Order, the Customer is informed about:

   • the main features of the Product,

   • the total price including taxes,

   • any additional costs.

5. The Customer confirms the Order by clicking “order with obligation to pay” or an equivalent button.

6. Placing an Order constitutes an offer to conclude an Agreement. The Agreement is concluded upon the Owner’s acceptance of the Order.

7. Order processing begins after the payment is received.

4. PRICES, PAYMENTS, AND DELIVERY

1. All Product prices include VAT.

2. The price listed at the time of placing the Order is binding.

3. The Owner reserves the right to change prices, introduce new Products, conduct and cancel promotions.

4. The Customer receives proof of purchase (receipt or VAT invoice) via email.

5. Available payment methods:

   • payment by card or online transfer via Stripe,

   • payment via PayPal.

6. Payments are processed by Stripe and PayPal.

7. Digital products are delivered via email within 24 hours after payment confirmation.

8. Delivery of digital Products is free of charge.

5. RIGHT TO WITHDRAW FROM THE AGREEMENT

1. A Customer who is a consumer may withdraw from the Agreement within 30 days of purchase by submitting a withdrawal statement.

2. Refunds will be processed within 14 days using the same payment method used by the Customer.

3. The right to withdraw does not apply to the purchase of digital Products delivered in a non-material form.

6. TECHNICAL REQUIREMENTS

1. To use the Platform and Products, the following are required:

   • an active email account,

   • an updated web browser with JavaScript enabled,

   • cookies enabled in the browser,

   • internet access,

   • ability to play video materials.

2. Complaints regarding Platform functionality may be submitted via email to educk@educk.org.

3. Responses to complaints will be provided within 14 days.

7. PERSONAL DATA AND COOKIES

1. Detailed rules for processing personal data and the use of cookies are described in the Privacy Policy.

8. COPYRIGHT

1. All Products available on the Platform are protected by copyright law.

2. Copying, recording, distributing, or publicly sharing Product content without the Owner’s consent is prohibited.

3. The Owner is not responsible for how Customers use the purchased content.

9. FINAL PROVISIONS

1. No provision of these Terms and Conditions limits consumer rights under applicable Polish law.

2. Any disputes will be resolved in accordance with Polish law.

3. Consumers may use the ODR platform available at http://ec.europa.eu/consumers/odr to resolve disputes.

4. These Terms and Conditions have been in effect since February 1, 2020.

5. The Owner reserves the right to amend these Terms and Conditions. Changes take effect from the date of publication on the Platform.
